Before you begin the application process, it's important to understand the purpose of the Digital Nomad Visa and why governments offer it in the first place.

Most people view the Digital Nomad Visa as nothing more than a residence and work permit for remote workers who meet certain eligibility requirements. While that is technically correct, it only tells part of the story. Many applicants never consider the broader purpose behind the visa, which often leaves them unprepared for the long-term responsibilities that come with it.

As a result, some struggle to maintain the conditions required to keep their visa. Many eventually decide to leave the country, while others find themselves unable to renew their permit because they no longer meet the eligibility criteria.

The Economic Purpose of the Digital Nomad Visa

At its core, the Digital Nomad Visa is an economic policy designed to attract foreign income into a country's economy. Rather than creating new jobs for local employers, it encourages remote professionals to relocate while continuing to earn income from clients or companies based abroad.

In Spain's case, the Digital Nomad Visa is a temporary residence and work permit granted to individuals who earn their income outside Spain and choose to live there. The Spanish government benefits because those individuals bring money generated in other economies into Spain, where they spend it on housing, food, transportation, entertainment, taxes, and everyday living expenses.

From Spain's perspective, this represents an inflow of foreign income that stimulates the local economy without requiring the country to create the jobs that generate that income. In other words, Spain imports spending power rather than exporting its own economic resources.

This economic principle is the foundation of digital nomad visa programs around the world. Although each country has its own eligibility requirements and regulations, the underlying objective remains the same: to attract skilled professionals whose foreign-earned income contributes directly to the local economy.

Spain's 20% Rule

One of the unique aspects of Spain's Digital Nomad Visa is the 20% rule .

While your primary source of income must come from outside Spain, the visa also allows you to earn income from Spanish clients or companies. However, there is an important limitation: income earned within Spain cannot exceed 20% of your total annual income.

In practical terms, this means you can increase your overall income by up to 25% through work performed for clients in Spain, provided that your foreign income remains the majority of your earnings.

For example:

Foreign income: €100,000 per year
Income earned in Spain: €25,000 per year
Total annual income: €125,000

This means:

Income from Spain: €25,000 (20% of total income)
Income from outside Spain: €100,000 (80% of total income)

The Minimum Income Requirement

Although every country has its own eligibility criteria, Spain requires Digital Nomad Visa applicants to earn a minimum monthly income equal to twice the Spanish minimum wage . At the time of writing, this amounts to approximately €2,850 per month .

During the application process, the authorities generally review only your most recent three months of income. However, if your intention is to continue living in Spain under this visa, you should think beyond the application itself.

You need to be able to maintain this level of income throughout the entire validity of your residence permit—not just for the months leading up to your application.

Many applicants have successfully qualified by temporarily increasing their income for three months, only to discover later that they could not continue meeting the requirements. As a result, they were unable to renew their residence permit and eventually had to leave Spain. The authorities have become increasingly strict over time, and compliance checks continue to become more rigorous.

Why Spain Is Tightening the Rules

A good example of this trend is a requirement that was introduced in the year I submitted my own application.

Applicants are now required to declare that they will register as a self-employed person with the tax-office in Spain and begin making the appropriate social security contributions.

The reason for this change is straightforward. In the past, some visa holders obtained their residence permit but took no further steps after arriving. They simply remained in Spain for the duration of their visa without registering properly or making any meaningful economic contribution.

As a result, Spain has introduced additional safeguards to ensure that the Digital Nomad Visa fulfills its original economic purpose. The idea of obtaining the visa simply to spend three years traveling around Europe without contributing to Spain's economy is becoming increasingly difficult.

Although you may still come across people claiming this is possible, I have personally seen cases where authorities monitored compliance and revoked visas when applicants failed to meet their obligations.

The Bigger Picture

The minimum income requirement serves several purposes.

First, it demonstrates that you have a stable source of foreign income. Second, it provides evidence of your professional qualifications and ability to sustain remote work. Finally, it shows that you have the financial means to support yourself comfortably while living in Spain and actively participating in the local economy.

Meeting the income requirement isn't just about getting your application approved. You must continue to satisfy these conditions throughout the duration of your residence permit. As income thresholds increase over time, you must also be able to keep pace with those changes.

If you cannot maintain the required level of income, renewing your Digital Nomad Visa may no longer be possible.

Your Responsibilities Begin After the Visa Is Approved

Obtaining your Digital Nomad Visa is only the first step. Once your visa is approved and you become a resident of Spain, you also take on a number of legal, tax, and administrative responsibilities.

The most significant of these is taxation.

Because you are bringing your income into Spain and becoming a Spanish tax resident, you are required to pay income tax in Spain under Spanish tax law. Your obligations are not limited to income generated only from your activities in in Spain. As a Spanish tax resident, your worldwide income is subject to Spanish tax reporting and taxation, depending on your circumstances and any applicable tax treaties.

Tax is only one part of the picture.

You will also need to register with the Spanish social security system and make the appropriate contributions, much like social security obligations in many other countries.

While income earned from clients outside Spain is generally exempt from Spanish VAT, income earned from Spanish clients is typically subject to Spanish VAT and other domestic tax reporting requirements.

For this reason, most Digital Nomad Visa holders work with a qualified accountant which is called a "Gestor". Proper bookkeeping, timely tax filings, and ongoing compliance with Spanish regulations are essential throughout your stay.

Living in Spain Means Participating in the System

In simple terms, the Digital Nomad Visa is an agreement between you and the Spanish government.

In exchange for the right to live and work in Spain and enjoy the benefits, you are expected to contribute to the country's economy by paying taxes, complying with local regulations, and maintaining the financial requirements that made you eligible for the visa in the first place.

After receiving your visa, your ongoing responsibilities typically include:

Registering as a self-employed Spanish taxpayer. (Autonomo)
Filing the necessary tax returns and declarations.
Opening and maintaining a Spanish bank account.
Keeping accurate accounting and financial records.
Working with an accountant to remain compliant with Spanish tax regulations.
Meeting your social security obligations.
Maintaining the income level required for your visa.
Spending the minimum amount of time in Spain necessary to maintain your residence status.

If your goal is simply to obtain a residence permit without fulfilling these ongoing responsibilities, you are likely to encounter problems sooner or later. Spain has continued to strengthen its compliance and enforcement measures, making it increasingly difficult for visa holders to ignore their legal obligations while keeping their residence status.

Although Spain makes updates to the application requirements from time to time, the core eligibility criteria have remained largely unchanged for years.

In general, anyone who works remotely for a company based outside Spain or is self-employed with clients outside Spain can apply, provided they meet the minimum income requirement.

However, meeting the eligibility criteria is only the first step. The real challenge is proving that you meet those requirements using the exact documentation requested by the Spanish authorities.

Spain has very strict rules regarding the documents they accept, how those documents must be translated, and which ones require an apostille. In many cases, there is more than one way to prove a particular requirement, but choosing the wrong document or overlooking a small detail can result in your application being rejected.

I've also seen cases where applicants clearly met the legal requirements but struggled to obtain the necessary documents from their home country.

For that reason, I strongly recommend working with an experienced immigration lawyer or a professional visa consultancy firm. There are many firms offering this service, but choosing the right one is just as important as preparing your application correctly.

Who Can Apply?

In general, you may be eligible to apply if you:

Work remotely for a company based outside Spain.
Are self-employed or operate your own business serving clients outside Spain.
Have a clean criminal record in both your home country and Spain.
Meet the current minimum income requirement.
Can demonstrate either a relevant university degree or at least three years of professional experience in your field.
Commit to registering as a self-employed professional (Autónomo), paying social security contributions and taxes in Spain.

Meeting these requirements is the starting point—not the finish line.

Proving Your Eligibility

Qualifying for the Digital Nomad Visa is one thing. Proving your eligibility with the correct documentation is often the most difficult and time-consuming part of the process.

During my own application, I had the opportunity to meet applicants from many different countries and learn about their experiences. Regardless of nationality, preparing the required documentation was almost always the biggest challenge.

For every eligibility requirement, the Spanish government expects specific supporting documents. Nearly all of these documents must be officially translated into Spanish and, where required, legalized with an apostille.

Even a minor oversight can delay or jeopardize your application. In my own case, a single untranslated word on one document was enough to create unnecessary delays.

The lesson is simple: attention to detail matters.

The Required Documents Are Not the Same for Everyone!

The documents you'll need depend largely on your employment and income status.

Someone employed by a foreign company will be asked to provide different documentation than a freelancer, self-employed professional, or business owner.

The paperwork also extends beyond your personal documents. Depending on your circumstances, you need to obtain supporting documents from your employer, your company and your clients.

In most cases, you will need to prepare new documents or amend existing documents like contracts so they contain the specific wording required by the Spanish authorities. Applications are often reviewed down to the exact wording, making accuracy extremely important.

Generally speaking, the required documentation falls into three categories:

Personal documents.
Financial and income documents.
Company and/or client documents.

Can You Apply?

If you believe you meet the eligibility requirements and can obtain the necessary documentation, then you can submit an application.

You have two options:

Apply through the Spanish Consulate in your home country.
Apply from within Spain.

The outcome depends on where you apply.

Applications submitted through a Spanish consulate are generally issued with a one-year residence and work permit.

Applications submitted from within Spain are generally approved with a three-year residence and work permit.

For this reason, applying from within Spain is often the more attractive option, and it's the route I chose myself.

However, applying from Spain requires careful planning. You'll need to enter Spain legally—typically with a valid Schengen visa if required for your nationality—and ensure that your application is submitted within the permitted timeframes. Because the rules surrounding entry, visa validity, and application deadlines can be complex, it's essential to understand the process before choosing this route.

Things to know when applying within Spain

Three Years vs One Year Permit!

If your application is approved while applying from within Spain, you will receive a three-year permit , compared to the one-year permit issued for applications submitted through a Spanish consulate abroad.

You Only Need to Be in Spain on the Day You Apply

One of the official requirements for an in-country application is simply that you are required to be legally in Spain on the day you submit your application. You do not have to remain in Spain while your application is being processed. After submitting your application, you are free to return to your home country and wait for the decision.

If you come from a country which requires a Schengen visa to enter Spain then things might get tricky as you still need a valid visa to re-enter Spain to complete the final stages.

Automatically Assigned NIE

When you apply from within Spain, you are automatically assigned a NIE number (Your ID number if you get approved). This is important because it saves time as you don't need to get an appointment to get a NIE number after your visa is approved which can take considerable time.

The Advantage of Positive Administrative Silence

When you apply from within Spain, you are subject to Positive Administrative Silence, means that if the UGE doesn't respond within 20 business days, your application will be subject to automatic approval (which is another process and takes time). This doesn't exist when applying through a consulate.

If You are Required to have a Schengen Visa

If you come from a country which requires a visa, receiving approval for your Digital Nomad Visa does not mean you can immediately enter and leave Spain freely.

To enjoy unrestricted travel in and out of Spain—and throughout the Schengen Area as a resident—you must first receive your TIE (Tarjeta de Identidad de Extranjero) , Spain's physical residence card. That card will replace your Schengen visa.

Obtaining the TIE is a separate process that begins only after your application has been approved. Depending on appointment availability and processing times, it can take anywhere from two to six months before you have the card in your hands.

Until you receive your TIE, you must still rely on a valid Schengen visa if your nationality requires one to enter Spain.

This is one of the most important details that many applicants overlook.

Your Visa Approval Does Not Give You Freedom to Travel

The official rule stating that you only need to be in Spain on the day of your application was primarily designed for nationals of countries that do not require a visa to enter Spain.

For them, the process is straightforward: submit the application, return home if desired, and come back once the application has been approved to complete the remaining formalities. If, however, you need a Schengen visa to enter Spain, the situation is different.

If your Schengen visa expires while you are waiting for your TIE, you may not be able to re-enter Spain to complete the required appointments, even though your Digital Nomad Visa has already been approved.

On the other hand, if your Schengen visa remains valid for at least several more months after you submit your application, you can continue traveling between Spain and your home country until your residence card is issued.

For this reason, the validity of your Schengen visa should be part of your application strategy—not an afterthought . Planning your travel dates carefully can save you months of delays and unnecessary complications later in the process.

How Long Does the Application Take?

Regardless of which city in Spain you apply from, Spanish law requires the immigration authorities to respond to a Digital Nomad Visa application within 20 working days .

This legal principle is known as Positive Administrative Silence (Silencio Administrativo Positivo) .

Within that period, the authorities must issue one of three responses:

A request for additional documentation
Approval of your application
Rejection of your application

In practice, however, the process doesn't always move as smoothly as the law suggests.

Even if your application is complete and all your documents are in order, it is common to receive a request for additional documentation near the end of the 20-working-day period. This is often due to high application volumes, administrative delays, and the tendency for cases to be reviewed at the last minute.

A request for additional documents legally extends the processing period by another 10 working days , giving the authorities more time to review your application.

Sometimes the requested documents may seem unnecessary, or they may even be documents you have already submitted. This can be frustrating, but it is a common part of the process.

The same thing happened in my case. On the final day of the initial review period, I received a request for additional documents. It was stressful at the time, but as soon as I resubmitted the requested paperwork, my application was approved that very same day.

What Happens If They Don't Respond?

In the rare event that the authorities fail to respond within the legal time limits, you may be able to rely on the principle of Positive Administrative Silence to have your application treated as automatically approved.

Although this legal protection exists, enforcing it is not immediate. The additional administrative process can itself take several months—sometimes up to six months —so it should generally be viewed as a safeguard rather than an alternative route to faster approval.

Where Should You Apply from Within Spain?

Ultimately, this is a personal decision.

Legally, you are not required to submit your application in the city where you intend to live . You can apply from anywhere in Spain. However, my recommendation is to apply in the city where you plan to settle.

There are several practical reasons for this.

Although there isn't much you can do while your application is still being processed, you'll want to start familiarizing yourself with everything that comes after approval. There will be numerous appointments to schedule, government offices to visit, tax registrations to complete, accounting arrangements to make, and other administrative tasks to organize.

Each city operates slightly differently, and learning how these procedures work in your chosen location before your visa is approved will make the transition much smoother.

Don't Underestimate the Empadronamiento

One of the first things you'll need to arrange after your Digital Nomad Visa is approved is your Empadronamiento (municipal registration).

Without it, you won't be able to complete many of the essential administrative procedures required to establish yourself in Spain.

On paper, it sounds like a simple registration. In reality, especially in larger cities such as Barcelona or Madrid, obtaining an Empadronamiento appointment can become one of the most frustrating parts of the entire relocation process.

Coming from Turkey, I was surprised by how difficult this seemingly straightforward procedure could be. What would normally take just a few minutes back home can require weeks of planning, repeated appointment checks, and a great deal of patience in Spain.

For that reason, I strongly recommend learning about the Empadronamiento process before you even submit your Digital Nomad Visa application. Understanding how it works—and planning for it in advance—will save you a considerable amount of time and stress once your visa has been approved.

Therefore this option is one of the most preferred for nationals who are required to have a Schengen visa to enter Spain.

You do not have to remain in Spain while your application is being processed. After submitting your application, you are free to return to your home country and wait for the decision. However you will still need to have a Schengen visa to go back and finish the formalities when your visa is approved.

The Importance of Your TIE Card

Receiving approval for your Digital Nomad Visa does not mean you can immediately enter and leave Spain freely.

Until you receive your TIE, you must still rely on a valid Schengen visa if your nationality requires one to enter Spain.

If you're planning a trip to Spain or any other country in the Schengen Area, it's important to understand the Schengen 90/180-day rule . Many travelers mistakenly believe they can stay for 90 consecutive days every time they enter the Schengen Area, but that's not how the rule works.

Misunderstanding this rule can lead to overstaying your permitted visit, which may result in fines, future entry restrictions, or other immigration issues.

What Is the 90/180-Day Rule?

The Schengen Area allows visitors from many non-EU countries to stay for up to 90 days within any rolling 180-day period without obtaining a long-term visa or residence permit.

The key phrase is "rolling 180-day period."

This means that on any given day you are in the Schengen Area, immigration authorities look back at the previous 180 days and count how many days you have already spent there. If that total reaches 90 days, you must leave until enough previous days fall outside the 180-day window

Leaving Doesn't Reset the Clock

Another common misconception is that leaving the Schengen Area for a few days automatically gives you another 90 days.

Unfortunately, this isn't true.

The calculation is always based on the previous 180 days. If you've already used your 90-day allowance, you'll need to wait until enough of those earlier days fall outside the rolling 180-day period before you can return.

You Should Keep Track of Your Days

If you travel frequently, it's a good idea to keep a record of your entry and exit dates.

There are also several online Schengen stay calculators that can help estimate how many days you have remaining under the 90/180-day rule. However, you should always rely on your own travel records and official guidance when planning your trips.

What If You Only Have a Short-Term Schengen Visa?

If you are unable to obtain a long-term Schengen visa, or if your visa is due to expire shortly after you submit your application, you can still apply for Spain's Digital Nomad Visa.

The difference is that you will need to remain in Spain until you receive your TIE (Tarjeta de Identidad de Extranjero), your physical residence card.

The Right to Stay in Spain Without a Visa

One of the legal protections built into the application process is that, once you have submitted your application, you have the right to remain in Spain while your case is being processed— even if your Schengen visa expires during that time.

For example, if you enter Spain on a Schengen visa and submit your application, it does not matter if your Schengen visa expires the following day. As long as your Digital Nomad Visa application is still pending, you are legally allowed to stay in Spain until a decision has been made.

If you choose this approach, you should prepare carefully. You should have sufficient accommodation, savings, and other arrangements in place to support yourself for several months. In practice, I recommend planning for at least six months , just in case there are delays.

During this period, you are free to travel within Spain and stay in different cities while your application is being processed. However, even if your application is approved, you should not leave Spain until you have collected your TIE .

If you leave Spain before receiving your residence card, you may not be able to re-enter unless you still have a valid Schengen visa.

In genuine emergencies—such as the death of an immediate family member—it is possible to apply for a special travel authorization known as an Autorización de Regreso (Return Authorization) . This permit allows you to leave Spain temporarily and return before receiving your TIE. Without this authorization, leaving Spain could mean you need a new Schengen visa before you are allowed back into the country.

My Experience

I chose to apply within Spain on a Schengen visa.

I travelled to Spain while my Schengen visa was still valid, submitted my Digital Nomad Visa application, and returned home the following day.

Then, just one day before my Schengen visa expired, I travelled back to Spain and remained there until my application was approved and I received my TIE.

From the time I returned to Spain until I collected my residence card, the process took approximately two months .

For me, this approach worked well, but it required careful planning and close attention to the validity of my Schengen visa.

What is Empadronamiento?

Empadronamiento aka Padron!

If you are planning to move to Spain—whether on a Spanish Digital Nomad Visa, a work permit, a student visa, or another type of residence permit—you will almost certainly hear the word empadronamiento or padron . It is one of the first administrative procedures you need to complete after becoming a resident, and it plays an important role in accessing public services and completing other legal processes.

Although it is often described as a simple address registration, the empadronamiento is much more than that. Understanding what it is, why it matters, and how to obtain it can save you significant time and frustration during your first months in Spain.

What Is an Empadronamiento?

An empadronamiento is your official registration in the Padrón Municipal de Habitantes , the municipal register maintained by every local council (Ayuntamiento) in Spain.

By registering, you officially declare that you live at a particular address within that municipality. Once your registration is approved, you receive a Certificado de Empadronamiento (Certificate of Registration) or a Volante de Empadronamiento , depending on what is required for your particular administrative procedure.

The empadronamiento does not grant residency rights or immigration status. Instead, it is simply the government's official record of where you live. It is your official address.

This is the address where you will receive official mail, issued cards etc.

Why Is It Important?

Many government offices and public institutions use the empadronamiento to verify your address. Without it, completing other administrative procedures can become difficult or even impossible.

Depending on your situation, you will need an empadronamiento to:

Apply for your TIE (Foreigner Identity Card)
Register with the Spanish healthcare system
Register with the tax office
Obtain a digital certificate (Required for accounting)
Register a vehicle
Exchange a foreign driving licence (where applicable)
Access certain local public services
Open a Spanish bank account
Enroll children in public schools

For most people relocating to Spain, obtaining an empadronamiento is one of the first priorities after securing accommodation. And it is legally required if you plan to stay more than 183 days in Spain.

Is It Required for Digital Nomad Visa Holders?

Yes. For many people applying for the Spanish Digital Nomad Visa from within Spain, the empadronamiento becomes an important step after residence has been granted.

Because of this, it is generally advisable to arrange suitable accommodation that allows you to register your address as early as possible.

What Documents Are Usually Required?

Requirements vary slightly between municipalities, but applicants are commonly asked to provide:

Passport or national identity document
Residence permit or visa (if applicable)
NIE, if already assigned
Proof of your address, such as:
Rental contract (must be longer than 6 months)
Written document from the owner of the flat stating you reside at the address if you rented a room
Written authorization from the property owner (if living with someone else)
Completed application form provided by the local town hall

Most of the municipalities also require appointments before you can submit your application and it can take up to 3 months to get one!

Where Do You Apply?

Applications are submitted to the Ayuntamiento (Town Hall) responsible for the municipality where you live.

Many larger cities, including Madrid, Barcelona, Valencia, and Málaga, require appointments that may be booked several weeks/months in advance. Smaller municipalities may have much shorter waiting times.

Some town halls also allow certain parts of the process to be completed online if you already possess a Spanish digital certificate. But getting a digital certificate requires an empadronamineto so it turns into an infinite loop.

If you live with someone without paying rent and they are already registered and have a digital certificate they will most likely be able to do it for you without going.

How Long Does the Process Take?

The registration appointment itself is usually quite short.

Depending on the municipality, you may receive your registration certificate immediately, while others issue it a few days later.

The biggest delay is often obtaining an appointment rather than the registration itself.

What If You're Renting a Room?

You do not necessarily need to rent an entire apartment.

Many people successfully register while renting a room, provided they have the appropriate documentation. Depending on the municipality, this may include:

A valid rental agreement
Written authorization from the primary tenant or property owner
Identification documents from the person authorizing your registration
If you are renting a room from someone already who has rented the apartment then they will need to provide the official rental contract as well

Each town hall has its own requirements, so it is important to check them before your appointment.

Why Finding an Address Can Be Challenging

One issue many newcomers underestimate is that not every landlord allows tenants to register their address. So you have to ask before going into an agreement whether you can get your empadronamineto.

Some property owners refuse empadronamiento registrations because of misunderstandings about taxes or tenancy rights. If you get a "padron" at an address it becomes your residency and the government limits the rent for the property and landlords try to avoid this.

This means that before signing a rental agreement, it is worth confirming that you will be permitted to register at the property.

For digital nomads, this can become particularly important because delays in obtaining an empadronamiento may also delay later administrative procedures. Most likely you will not be able to start any procedures without it.

Also its worth knowing that due to the bad reputation of previous Digital Nomads in the country they might be reluctant to rent for remote workers.

Locals renting rooms might also not want someone in their house all day so you might be declined.

Does the Empadronamiento Expire?

For Spanish citizens, the registration generally remains valid unless they move to another municipality.

Foreign nationals without permanent residence are required to renew or confirm their registration after 3 years.

If you move to a new address within Spain, you should update your registration with the new local town hall.

The document itself has an issue date on it and in most cases officials will not except a document more than 3 months old . You will need to go to a town hall (without appointment) and get one printed from available service machines or you can get one online if you have a digital certificate.

Getting An Appointment
